Beginning March 9, 2009 Kijiji,
eBay Inc.’s free, local classified Web site will kick off the Pet Fitness Sweepstakes. With spring right around the corner, many Americans will
begin to prepare for “beach season” by working out and developing better eating
habits. Kijiji wants pet owners to
also have the opportunity to get their pets ready for “beach season.” The Sweepstakes is in conjunction with
Kijiji’s campaign to raise awareness about the importance of pet fitness and
nutrition. Because 44% of dogs and
57% of cats are estimated to be overweight or obese, according to the Association
for Pet Obesity Prevention, Kijiji is offering pet owners in the Houston area the
opportunity to win $1,000 gift certificate to a local pet store for the necessities
to get their pet healthy and fit.
To enter the Sweepstakes, pet owners can simply submit a photo of their pet
deserving a fitness makeover and enter them into Kijiji’s Pet Fitness
Sweepstakes. Select entries will be featured on the
special pets page at http://Houston.Kijiji.com. One
entry will be selected at random receiving a $1,000 gift certificate to a local
pet store to purchase the necessities they need to help their pet get fit this
spring.
Kijiji (www.kijiji.com), which means “village” in
Swahili, launched in 200 cities in the U.S. on June 29, 2007. The online
community is a free, local, easy and clean site to view and post classified
ads. Kijiji.com features popular classifieds categories such as For Sale,
Housing, Cars & Vehicles, Jobs, Pets, and Services. In addition to the
U.S., Kijiji has online communities in Canada, Austria, France, Germany, Italy,
Switzerland, Japan and Taiwan. Kijiji is part of a broader eBay Global Classifieds
family including Gumtree, Marktplaats, Mobile.de and Loquo, which extends the
reach of eBay Global Classifieds to more than 20 countries.

To enter online, go to http://Houston.Kijiji.com and click on “Enter Kijiji’s Pet Fitness Sweepstakes” link. Complete the online entry form which will ask for your name, your complete
mailing address, telephone number, your pets name, your pets breed, and a photo
of your pet deserving a fitness makeover. Your entry must be received by 11:59 PM ET Thursday, April 30, 2009. NO PURCHASE NECESSARY TO ENTER OR
WIN. A PURCHASE DOES NOT IMPROVE

1. ELIGIBILITY: Open to legal residents of Houston who are at least 18 years
of age and have reached the age of majority in their home state by March 9,
2009. Employees, officers and
directors of Kijiji / eBay Inc. (the Sponsor), its parent, subsidiaries, affiliates,
advertising and promotion agencies, M Booth & Associates (the Sweepstakes Administrator"),
and members of the immediate families (spouses and children, parents and
siblings and their spouses) or members of the same households (whether related
or not) of such individuals are not eligible. Void where taxed, restricted, or prohibited.
3. TO ENTER: You may enter the Sweepstakes online. To enter online, go to http://Houston.Kijiji.com and click on
the “Enter Kijiji’s Pet Fitness Sweepstakes”
link, then enter your name, your complete mailing address, telephone number, your
pet’s name, your pet’s breed, and a photo of the pet deserving a fitness
makeover. The
photograph must be 200 DPI and 5 inches by 7 inches or less.
You may enter one pet per day, but each entry must be for a
different pet and must meet all entry requirements and must be submitted
separately.
By submitting an
entry, you warrant and represent that your entry, including without limitation,
each submitted photograph: (i) is
your own original work created by you; (ii) depicts a pet belonging to
you;(iii) has not been previously published; and (iv) that you own or otherwise
control all of the rights to your entry materials and that your entry does not
violate any law, regulation or any right of any third-party (without such
party’s written permission), including but not limited to rights of copyright, trademark,
publicity and privacy, as solely determined by Sponsor. All entries become the sole and
exclusive property of Sponsor, Sponsor
is under no obligation to correspond about entries nor will entries be
acknowledged or returned. Sponsor reserves the right in its sole discretion to
disqualify any entry at any time in the event it is determined that the entrant
has not complied with these Official Rules.
Entrants grant and
assign the Sponsor all rights of ownership, reproduction, and use of entries,
including but not limited to each submitted photograph, for any purpose
whatsoever without compensation or further permission. Such rights shall include but are not
limited to the right to assign, use, publish, edit, adapt, modify, alter,
reproduce, distribute, display, copyright, create derivative works or otherwise
exploit entries, for commercial or non-commercial use, in any media now known
or hereafter invented, worldwide, in perpetuity and without compensation to the
entrant.
4. DETERMINING
WINNERS: On or about May 1, 2009, the Sweepstakes Administrator will select one
(1) winner at random from all eligible entries received. Sponsor and Sweepstakes Administrator have complete discretion over
interpretation of Official Sweepstakes Rules, administration of the Sweepstakes and selection of the winner. Decisions of the Sweepstakes
Administrator as to the administration of the Sweepstakes, interpretation of
the Official Rules and selection of the winner will be final. Odds of winning
depend on the number of eligible entries received.
5. PRIZES: One (1)
Grand Prize: The winner will receive a $1,000 gift card to a local pet store to
be used to help their pet get fit. (Approximate
Retail Value $1,000)
6. GENERAL: Entries
are accepted and the prize is awarded on the condition that all entry materials
are the sole property of the entrant and that they have not been accepted for
publication elsewhere. The entrant entering the potentially winning entry will be
required to [a] complete an affidavit of eligibility, a liability release and
(where legal) a publicity release, which must be returned within the time
specified in the notification letter; and [b] execute an assignment of all
intellectual property rights in the winning entry, including but not limited to
each submitted photograph to the Sponsor. Failure to comply may result in
forfeiture of prize and award to an alternate winner based on
random drawing. Sponsor is under no obligation to use or publish winning entry. Taxes on the prize and all expenses
related to acceptance and use of the prize not expressly specified
herein these Official Rules are the sole responsibility of the winner. Entrants
agree to be bound by the terms of these Official Rules and by the decisions of
the Sponsor and Sweepstakes Administrator, which are final and binding on all
matters pertaining to this Sweepstakes. Sweepstakes is subject to all federal, state and local laws. By
participating, entrants and winner, as applicable, release,
discharge and hold harmless Sponsor, its parent, subsidiaries, affiliates,
advertising and promotional partners and agencies, including Sweepstakes Administrator,
and each of their respective directors, officers, employees, representatives
and agents from any and all injuries, liability, losses and damages of any kind
resulting from their participation in the Sweepstakes and/ their acceptance,
use or misuse of a prize including, without limitation, personal injury, death
and property damage; and claims based on any violation of publicity rights,
copyrights, trademark defamation or invasion of privacy. By accepting the prize,
the winner grants Sponsor the use of his/her name, photograph, voice, likeness,
video footage, and any statements or biographical information he/she provides,
for trade, advertising, publicity, and promotional purposes without
compensation (unless prohibited by law) by Sponsor and those acting pursuant to
Sponsor's direction, in each case in all media now known or hereafter
discovered, worldwide, including but not limited to the internet, without
notice, review, or approval, and agrees, upon request, to confirm the foregoing
in writing. Sponsor, its parent, subsidiaries, affiliates, advertising and
promotional partners and agencies, and all of their respective directors,
officers, employees, representatives and agents are not responsible for and
shall not be liable for late, lost, misdirected, illegible, postage-due,
damaged or incomplete entries or any condition caused by events that may cause
the promotion to be disrupted or corrupted. Sponsor reserves the right in its
sole discretion to cancel, terminate, modify, or suspend the Sweepstakes and
limit entries to those submitted prior to the action taken, or to proceed in
such a manner as may be deemed fair and equitable by Sponsor in its sole
discretion. There shall be no prize transfer or cash redemption. No prize
substitution except by Sponsor due to unavailability, as solely determined by
Sponsor, in which case a prize of comparable or greater value will be awarded.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF
CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES
THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED
BY LAW. Internet entry must be made by the entrant only at the authorized Sweepstakes’
web site address [INCLUDE URL]. In case of dispute as to the identity of any
entrant, entry will be declared made by the authorized account holder of the
email address submitted at time of entry. “Authorized Account Holder” is
defined as the natural person who is assigned an email address by an Internet
access provider, online service provider, or other organization (e.g.,
business, educational institution, etc.) responsible for assigning email
addresses or the domain associated with the submitted email address. Any
potential winner may be requested to provide Sponsor with proof that such
winner is the authorized account holder of the email address associated with
the winning entry. Sponsor reserves
the right, at its sole discretion, to disqualify any individual it finds to be
tampering with the entry process or the operation of the Sweepstakes or its web
site; to be acting in violation of the Official Rules; to be acting in
violation of the terms of the Sweepstakes’ web site; or to be acting in a
non-sportsmanlike or disruptive manner, or with intent to annoy, abuse,
threaten or harass any other person.
7. WINNERS LIST: For of
the name of the winning entrant, mail a self-addressed, stamped envelope (VT
residents may omit return postage), between May 1, 2009 and June 15, 2009 to: Kijiji

8. PRIVACY POLICY Personal data about entrants will be
collected by Sponsor in accordance with its privacy policy. Please review
Sponsor's privacy policy for this Sweepstakes at www.kijiji.com. By participating in the Sweepstakes,
you hereby agree to such collection and usage of your personal information, and
acknowledge that you have read and agreed to the privacy policy set forth above.
