NATIONAL DECLUTTER DAY CONTEST RULES

Contest Description:

Beginning November 14, 2008, Kijiji, eBay’s local free classified Web site, and decluttering expert Tava Smiley, host of TLC’s hit show “Clean Sweep,”  will kick off the National Declutter Day Contest.  The Contest is in conjunction with the first annual National Declutter Day on Nov. 22.  National Declutter Day was organized to help those suffering from a “tongue-in-cheek” condition known as packratitis - a problem causing people to collect miscellaneous items over time and then have trouble getting rid of them, even if they are no longer useful. 

The National Declutter Day Contest is a way for you or a loved one to cure packratitis with the help of knowlegable experts. To nominate yourself or a loved one into the National Declutter Day Contest submit a photo of the offending untidiness and a 100-word essay at www.Kijiji.com. The person most in need of decluttering in their home will be visited by Tava Smiley and the experts at Kijiji. They will offer their organizational know-how and assistance in whipping the deserving winner’s cramped space into shipshape by putting un-needed items on Kijiji.

Kijiji (www.kijiji.com), which means “village” in Swahili, launched in 200 cities in the U.S. on June 29, 2007. The online community is a free, local, easy and clean site to view and post classified ads. Kijiji.com features popular classifieds categories such as For Sale, Housing, Cars & Vehicles, Jobs, Pets, and Services. In addition to the U.S., Kijiji has online communities in Canada, Austria, France, Germany, Italy, Switzerland, Japan and Taiwan. Kijiji is part of a broader eBay Global Classifieds family including Gumtree, Marktplaats, Mobile.de and Loquo, which extends the reach of eBay Global Classifieds to more than 20 countries. 

How to Enter

You may enter the contest either online at www.Kijiji.com.

Complete the online entry form which will ask for your name, the nomiee’s name (if applicable), the complete mailing address, telephone number, and email of you and the nominee (if applicable), and a 100 word (or less) statement describing why you or your loved one needs decluttering help from “Clean Sweep” host Tava Smiley and the Kijiji experts. Your entry must be received by 11:59 PM ET on December 31, 2008. The contest database is the official time keeping device for the contest.

You may enter as often as you wish, but each entry must be different and must be entered online separately.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

1.  ELIGIBILITY:  Open to legal residents of the 48 contiguous United States and the District of Columbia who are 18 years of age and older.  Employees, officers and directors of Kijiji / eBay (the Sponsor), its parent, subsidiaries, affiliates, advertising and promotion agencies, M Booth & Associates (the "Contest Administrator"), and members of the immediate families (spouses and children, parents and siblings and their spouses) or members of the same households (whether related or not) of such individuals are not eligible. Void where taxed, restricted, or prohibited.

2. PROGRAM DESCRIPTION: The National Declutter Day Contest (the “Contest”), is searching for the person in most need of a relief from their packratitis “condition” and a decluttering home makeover. The Contest begins at 6:00 AM Eastern Standard Time (“ET“) on November 14, 2008 and ends at 11:59 PM ET on December 31, 2008.

3. TO ENTER: You may enter the contest online. To enter online, go to www.Kijiji.com and click on the National Declutter Day link, then enter your name, the nominee’s name (if applicable), your complete mailing address, telephone number, and email, and a 100 word (or less) statement describing why you or your loved one needs decluttering help from “Clean Sweep” host Tava Smiley and Kijiji representitives. The nominee must be someone with whom you are personally acquainted, who meets the eligibility conditions of entry for the Contest (including without limitation having reached the age of majority in his/her home state by November 14, 2008) and you must have nominee’s written permission to nominate him/her and provide Sponsor with nominee’s contact information in the event your entry is selected as the winner. Such permission must include nominee’s agreement to these Official Rules and may be requested by the Sponsor at any time. Failure to produce such documentation may result in your entry’s disqualification. Your complete entry materials must be received by 11:59 PM ET on December 31, 2008. The Contest database is the official time keeping device for the Contest.

Each entry should include a short descprition of the cluttered room or space as stipulated in the entry form, and a photograph of the area and why your or your loved one is worthy of decluttering help from Tava Smiley and Kijiji representatives. The photograph must be 200 DPI and 5 inches by 7 inches or less.

You may enter as often as you wish, but each must be for a different nominee, include a different statement and photograph, must meet all entry requirements and must be submitted separately.

By submitting an entry, you warrant and represent that your entry materials, including without limitation both your statement and photograph, are your own original work created by you, have not been previously published, that you own or otherwise control all of the rights to your entry materials and that your entry does not violate any law, regulation or any right of any third-party without such party’s written permission, including but not limited to rights of copyright, trademark, publicity and privacy, as solely determined by Sponsor. Entries may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. All entries, become the property of Sponsor; Sponsor is under no obligation to correspond about entries nor will entries be acknowledged or returned. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.

Entrants grant and assign the Sponsor all rights of ownership, reproduction, and use of entries for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use, and without compensation to the entrant.

4. JUDGING/DETERMINING WINNERS: Within approximately four weeks from the Contest deadline, a team of judges, assembled by the Sponsors, the Contest Administrator and representatives for Tava Smiley, will review and judge all eligible entries based on the following breakdown: (i) 25% for creativity of photograph; (ii) 25% originality of statement; and (iii) 50% overall impression of immediate need to “cure” nominee’s “packratitis.” Subject to eligibility requirements and verification, the entry receiving the highest score will be deemed the winner of the Grand Prize. In the event of a tied score, the entry with the highest overall impression score will break such tie. Sponsors will contact the entrant who submitted the winning entry and such entrant shall be responsible for having the winning nominee reach Sponsor to provide appropriate contact information and receive prize details.

Sponsors have complete discretion over interpretation of Official Contest Rules, administration of the Contest and selection of the Winners. Decisions of the Sponsor as to the administration of the Contest, interpretation of the Official Contest Rules and selection of the Winner will be final.

5. One (1) Grand Prize: Tava Smiley, host of TLC’s hit show “Clean Sweep” and the decluttering experts at Kijiji, not more than seven representatives, will visit the home of the selected winning entry’s nominee to help that nominee declutter his or her space. Approximate Retail Value: $25,000. Date of visit will be based on availability of winning nominee, Tava Smiley representatives and Kijiji representatives between December 31, 2008 and March 31, 2009. Decluttering may include but is not limited to re-organizing the space, removing items from the space, listing items for sale on Kijiji and general advise on decluttering. Depending on availability, Smiley will visit the home of the winning nominee for two (2) consecutive hours, which must be located in the contiguous United States, and Smiley shall provide tips to de-clutter the winning nominee’s home, meet/greet, sign a reasonable number of autographs, and pose for a reasonable number of photos. Up to four(4) guests may be in attendance during the home visit and each shall be required to sign Sponsor’s release of liability and publicity. The Grand Prize is subject to nominee executing an appropriate affidavit of eligibility and liability/publicity release and failure to do so will result in the forfeiture of the Grand Prize and another entry will be selected as the winner.

6. GENERAL: Entries are accepted and prizes awarded on the condition that all entry materials are the sole property of the entrant and that they have not been accepted for publication elsewhere. The entrant entering the potentially winning entry and nominee will both be required to [a] complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within the time specified in the notification letter; and [b] sign a release and non-exclusive, irrevocable license of all intellectual property rights in the winning entry to the Sponsor. Failure to comply may result in forfeiture of prize and award to an alternate winner based on the applicable judging criteria. Taxes on prizes and all expenses related to acceptance and use of the prizes not specified are the sole responsibility of the winning nominee. Entrants agree to be bound by the terms of these Official Rules and by the decisions of the Sponsor and the judges, which are final and binding on all matters pertaining to this Contest. Contest is subject to all federal, state and local laws. By participating or agreeing to be nominated, as applicable, entrants and nominees’ release, discharge and hold harmless Sponsor, its parent, subsidiaries, affiliates, advertising and promotional partners and agencies, including Contest Administrator, and all of their respective directors, officers, employees, representatives and agents from any and all injuries, liability, losses and damages of any kind resulting from their participation in the promotion or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyrights, trademark defamation or invasion of privacy. By accepting the prize, the winning entrant and nominee each grants Sponsor the use of his/her name, photograph, voice, likeness, video footage, and any statements or biographical information he/she provides, for trade, advertising, publicity, and promotional purposes without compensation (unless prohibited by law) by Sponsor and those acting pursuant to Sponsor's direction, in each case in all media now known or hereafter discovered, worldwide, including but not limited to the World Wide Web, without notice, review, or approval, and agrees, upon request, to confirm the foregoing in writing. Sponsor, its parent, subsidiaries, affiliates, advertising and promotional partners and agencies, and all of their respective directors, officers, employees, representatives and agents are not responsible for and shall not be liable for late, lost, misdirected, illegible, postage-due, damaged or incomplete entries or any condition caused by events that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the contest and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. There shall be no prize transfer or cash redemption. No prize substitution except by Sponsor due to unavailability, as solely determined by Sponsor, in which case a prize of comparable or greater value will be awarded. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Internet entry must be made by the entrant only at authorized Web site address. In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or Web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of the Web site; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

7. WINNERS LIST: For of the name of the winning entrant and nominee, mail a self-addressed, stamped envelope (VT residents may omit resturn postage), between February 1, 2009 and March 31, 2009 to: Kijiji National Declutter Day Contest c/o M Booth & Associates, 300 Park Avenue South, Floor 12, New York, NY 10010.

8. PRIVACY POLICY: Sponsor/Contest Administrator will be collecting personal data about entrants and nominees in accordance with its privacy policy. Please review Sponsor's privacy policy for this Contest at www.kijiji.com By participating in the Contest, you hereby agree to such collection and usage of your personal information, and acknowledge that you have read and agreed to the Contest's privacy policy set forth above.
